Article 1 – Scope of Application

These General Terms and Conditions of Sale (referred to as 'GTC') apply, without restriction or reservation, to all sales concluded by the Seller (AMC CAPE GRACE) with non-professional Buyers ('The Clients' or 'The Client'), wishing to purchase products or services offered for sale by the Seller on the website 'www.amccapegrace.com'.

The products/services offered for sale on the Site include:

Sea excursions aboard maxi catamarans for full-day, half-day, and evening trips departing from the ports of Saint-Raphaël, Hyères, Nice, Marina Baie des Anges, and Marseille, exploring the most iconic spots of the Provence-Alpes-Côte d'Azur region, such as: the Lérins Islands in Cannes, Esterel, Agay Bay, Anthéor, Île d'Or in Saint-Raphaël, Cap Dramont, the Three Capes (Cap Camarat, Cap Taillat, Cap Lardier), Pampelonne Bay, the Gulf of Saint-Tropez, Fort de Brégançon, Giens Peninsula, Porquerolles Island, the Calanques of Marseille, the Frioul Archipelago, the Riou Archipelago, the Côte Bleue, the Nice coastline, Villefranche-sur-Mer, Saint-Jean Cap Ferrat, Cap d'Antibes…

Among the proposed excursions:

  • Full-day with meal

  • Morning escape

  • Morning discovery 

  • Afternoon farniente

  • Sunset at sea

  • Brunch at sea

  • Dinner evening

  • Fireworks at sea

  • Dinner evening and fireworks

All details and specifications of the products/services are presented on the website www.amccapegrace.com, and the Client is required to review them before placing an order online. The selection and purchase of a product/service are the sole responsibility of the Client.

The images used throughout the website www.amccapegrace.com are as accurate as possible but may not guarantee a perfect resemblance to the products and services offered.

These General Terms and Conditions of Sale are accessible at any time on the website www.amccapegrace.com and will prevail over any other document. The Client declares that they have read and accepted these GTC by checking the designated box before proceeding with the online ordering process on the website www.amccapegrace.com.

Unless proven otherwise, the data recorded in the Seller’s computer system constitutes proof of all transactions concluded with the Client.

Article 2 – Prices

The products and services are provided at the prices in effect on the www.amccapegrace.com website at the time of order registration by the Seller. Prices are expressed in euros (€), including all taxes (French VAT).

These rates are fixed and non-revisable during their validity period. However, the Seller reserves the right to modify prices at any time depending on economic conditions (surcharges, fuel prices, etc.) or tax modifications (VAT, TPM, port and usage taxes).

However, the products and services will be invoiced to the Client at the rate applicable at the time of order confirmation.

The amount payable by the Client corresponds to the total purchase amount.

Article 3 – Rservations / Online orders

It is the Client’s responsibility to select on the website www.amccapegrace.com the products and services they wish to order, according to the following terms:

The Client places their order online on the website www.amccapegrace.com. All contractual information is presented in both French and English.

The Client declares that they have read the GTC prior to placing their order and acknowledges that order validation implies acceptance of their terms.

To place an order, the Client must provide the Seller with personal data and complete an online form accessible from the website www.amccapegrace.com.

The sales contract between the Seller and the Client is formed when the Client checks the box 'I have read and accept the General Terms and Conditions of Sale' when confirming their order.

Until this final step, the Client has the option to return to previous pages and correct or modify their order and previously provided information.

A confirmation email, acknowledging receipt of the order and including all related details, will then be sent to the Client as soon as possible. Therefore, the Client must provide a valid email address when filling out the identity fields.

If a product or service ordered by the Client is unavailable, the Seller undertakes to inform the Client via email or telephone as soon as this unavailability is known.

Product and service offers are valid as long as they are visible on the website, within the limits of available stocks.

The sale will only be considered valid after full payment of the price. The Client is responsible for verifying the accuracy of their order and immediately reporting or correcting any errors.

Any order placed on the website www.amccapegrace.com constitutes the formation of a distance contract between the Client and the Seller.

The Seller reserves the right to cancel or refuse any order from a Client with whom there is a dispute regarding the payment of a previous order.

Article 4 – Payment Terms

The price is paid via secure payment, under the following conditions:

  • Payment by credit card

The price is payable in full by the Client on the day of the online order.

Payment data is exchanged in encrypted mode using the protocol defined by the authorized payment service provider handling banking transactions on the website www.amccapegrace.com.

Payments made by the Client will only be considered final after the Seller effectively collects the amounts due.

Article 5 – Ticket Delivery

Tickets will be sent directly via email.

The electronic ticket will be delivered to the contact details provided by the Client in the form completed during the online order. Any incorrect email address shall not engage the liability of AMC CAPE GRACE.

Article 6 – Conditions of Use - Regulations

The maritime company AMC CAPE GRACE reserves the right to modify, without prior notice, the days and times of sea excursions, the duration of services, or even their itinerary (due to weather conditions, technical issues, maintenance, insufficient attendance, etc.).

In case of a passenger’s delay, regardless of the reason, the crew reserves the right to depart without the latecomers. These passengers will not be eligible for a refund or access to another excursion for this reason.

Passengers must retain their electronic ticket to present it for any checks. They undertake, in all cases, to comply with the regulations established by the captain and crew while on board the vessels.

AMC CAPE GRACE does not allow clients to bring food and drinks on board the catamarans during sea excursions (except for small snacks or food for babies/children).

The company AMC CAPE GRACE reserves the right to modify or adjust the meals served on board depending on supply availability.

People with reduced mobility are welcome on board, but not all boats have standardized access. Please inform us in advance when making your reservation.

Pregnant women and babies are welcome on board unless otherwise advised by a doctor. Minors must be accompanied by an adult. Children remain entirely under the responsibility of their parents.

Pets are not allowed on board.

In general, shoes are not permitted on board.

AMC CAPE GRACE is not responsible for cash, jewelry, or other items brought by passengers, including their theft, loss, or deterioration due to natural boat movements, sea conditions, or other factors.

Bicycles are not allowed on board. Strollers may be taken on board.

Article 7 – Cancellation Conditions - Refunds

Tickets are valid for a specific date.

In case of no-show at boarding or in case of delay, tickets will not be refunded. Lost or stolen tickets cannot be refunded or exchanged.

In case of insufficient attendance, AMC CAPE GRACE reserves the right to cancel a sea excursion at any time or reschedule the trip to another date. The Client will be offered either a new excursion date or a full refund.

  • Without the 'Meetch cancellation insurance' option:

Tickets are non-refundable. If the Client cancels their reservation, regardless of the reason, no refund will be granted.

If a sea excursion is canceled by AMC CAPE GRACE (due to weather conditions, technical issues, insufficient attendance, or other reasons), the trip will either be rescheduled for another date or fully refunded to the Client.

AMC CAPE GRACE allows the Client to reschedule their cruise for a later date within the current season, subject to availability.

Rescheduling is only possible if the Client informs the provider by phone or email at least 72 hours before the scheduled departure date. Reservations cannot be modified less than 72 hours before boarding.

  • With the 'Meetch cancellation insurance' option:

A 'cancellation insurance' option is offered to the Client during the online booking process. This option, managed by the external provider Meetch, is priced at 9% of the total booking amount, including VAT.

By subscribing to the 'cancellation insurance', the Client may cancel their reservation up to the day of the excursion. They will be refunded 70% of the total amount within 48 hours without justification or 100% with valid proof.

Article 8 – Boarding

The Client is informed that passenger boarding occurs 10 minutes before the scheduled departure time of the vessel.

In case of no-show at boarding or delay, regardless of the reason, tickets will not be refunded.

Article 9 – Gift Vouchers

Gift vouchers are available for purchase on the www.amccapegrace.com website. They come with a unique code and are valid for one year from the date of purchase. Beyond this expiry date, gift vouchers are neither refundable nor exchangeable.

To redeem a gift voucher, the Client must enter the unique code in the designated field during the online booking process or present this unique code in-store to book the desired excursion.

The gift voucher must be presented at the time of booking. If the Client or recipient is not present on the day of the service, the gift voucher is neither refundable nor exchangeable.

Lost or stolen gift vouchers cannot be exchanged or refunded.

Article 10 – Liability

All passengers aboard AMC CAPE GRACE catamarans must comply with the established regulations and the instructions of the captain and crew. AMC CAPE GRACE cannot be held responsible for the Client's non-compliance with safety instructions.

AMC CAPE GRACE is not liable for any damage, loss, or theft of personal belongings belonging to passengers, particularly due to natural boat movements, weather conditions, or other factors.

AMC CAPE GRACE cannot be held responsible for delays or cancellations caused by weather conditions.

Article 11 – Personal Data

The Client is informed that the collection of their personal data is necessary for the sale of products/services and their delivery. This personal data is collected exclusively for the execution of the sales contract. See legal notices here.

Article 12 – Intellectual Property

The content of the website www.amccapegrace.com is the property of the Seller and is protected by French and international laws on intellectual property.

Any total or partial reproduction of this content is strictly prohibited and may constitute an act of counterfeiting.

Article 13 – Governing Law

These General Terms and Conditions of Sale and the resulting transactions are governed and subject to French law.
